The following are terms of a legal agreement between the names you the user/Tenant(s)/Occupants provided as “Users/Occupants/Lessees” and L.A. Monticelli and L.A. Monticelli trustee of the Monticelli Trust and Bonfidegroup.com. When you (the Tenant/Occupants) pay for the use of this housing/property through Paypal, personal check or in cash Users/Tenant/Occupants acknowledge and agree that all Tenants/Occupants read, understood and agreed to be bound by these terms and conditions of this Agreement, and to comply with all applicable laws and regulations, including local, state and federal laws and regulations governing leased housing/property.

For the purposes of this agreement “You, User, Lessee, and Occupants hereinafter shall be referred to as “Users”.

For the purposes of this agreement L.A. Monticelli, L.A. Monticelli Trustee of the Monticelli Trust and Bonfidegroup.com hereinafter shall be referred to as “Owner”.

For the purposes of this Lease agreement Use/Occupancy Agreement/Short Term Rental Agreement shall hereinafter be referred to as “This Agreement” or “Agreement”.  This agreement shall include any addendums between Users and Owner. This agreement is specific and refers to terms of use for Owners house/property.

“The site” is referring to www.bonafidegroup.com, owner’s web address/internet site.

PLEASE READ THE TERMS AND CONDITIONS OF USE CAREFULLY BEFORE PAYING FOR HOUSING ON PAYPAL, personal check or in cash.   By paying for housing, Users are agreeing to comply with and be bound by this Agreement.   After reviewing the following terms and conditions thoroughly, if you do not agree to the terms and conditions, please do not pay for housing.

  1. Acceptance of This Agreement. You agree to the terms and conditions outlined in this Agreement with respect to our housing/property. This Agreement constitutes the entire and only agreement between us and you, and supersedes all prior or contemporaneous agreements, representations, warranties and understandings with respect to the housing/property, the content, offers for services provided by or listed about the Housing/Property, and the subject matter of this Agreement. This Agreement may be amended by us at any time and at any frequency without specific notice to you, unless you are occupying the housing at the time of notice. The latest Agreement will be posted on this Site, and you should review this Agreement prior to paying for housing/property each time.
  2.  Deleting and Modification. We reserve the right in our sole discretion, without any obligation and without any notice requirement to you, to edit or delete any documents, information or other content appearing on the Site, including this Agreement.   And current Users shall be given 30-day notice of amended information.

Upon receipt of payment by Owner, Users, their invitees, family and guests are hereby agreeing to the following terms and conditions of rental property.                       

Term.  The term will commence and terminate in accordance with occupancy dates stipulated in PayPal “Communication with vendor” or any email received from User stipulating dates of occupancy.  Term is further clarified by the amount of rent due and payable in advance to Owner.  The first day of occupancy shall commence at 2pm.  The last day of occupancy shall terminate at 12:00 noon.  Dates of occupancy, or term of tenancy shall be stipulated in Paypal’s Instructions To Merchant, or communicated in separate email.  There is no hold-over period and there shall be no holding over without prior consent of Owner.

Rent.  Rent is stipulated on “Make Reservations” page of website, www.bonafidegroup.com.,   Rent for the term shall be paid in advance through PayPal, via personal check, or in cash. 

Use:   The premise will be used exclusively as a single family dwelling (referred to as "residence") not to exceed a maximum of two (2) persons per bedroom.  Users shall specify the exact number of people in the home in advance of their arrival.  The residence is for no more than the designated number of persons agreed upon between Owner and User and only for persons listed by User, but never more than allowed by California State Law.  The premise shall be used solely by Users.  Should Users violate agreement bringing more guests than they have stipulated, or by bringing additional guests Owner will charge User an additional per person, per day fee of $40.00 which will be collected at the time the violation is noted, or any gross misuse will result in Owner requiring Users to vacate the premise without refund. 

Occupants agree to keep the premise clean, in good order, and agree not to hamper, disturb or interfere, nor to create or suffer any nuisance in or on the premises affecting the quiet enjoyment rights of others.  Upon departure Occupant agrees to surrender possession in as good condition and repair as when received and in accordance with House Rules.  The premise is to be left, broom swept, all the dishes are to be done and put away, garbage shall be placed outside in trash receptacles, stove will be wiped down/out.  Occupant agrees to be financially responsible for any/all damage incurred, without limitation. No additional furniture, cots or additional beds will be brought into the premise for any reason.

Security Deposit:  The amount of the security deposit is $___________.  Security deposits are not to be utilized as rent by User.  Owner  may apply portion of deposit to the account of the User.  Owner is obligated to refund security deposit if there is no rent owed, no damage to the premise and the unit is left clean and broom swept.  Any balance of the deposit to be refunded Occupant/Tenant shall be postmarked within 21 days of the date possession of premise is delivered by Occupant/Tenant.  Any/all pet deposits are non refundable cleaning deposits.

Facility:  Premises are fully furnished by Owner including a range, refrigerator, microwave, television(s), wireless internet, linens, flatware, dishes and cooking utensils.  All contents are in good condition and are to be returned in the same condition.  Rules and Regulation are posted on every refrigerator stating what Users must do before turning residence back to Owner.  Tenant agrees to follow those requirements are agrees to pay an additional cleaning deposit of $75.00 plus damages.

House Rules:  Users agree to abide by all house rules, including rules with respect to smoking noise, odors, disposal of refuse, animals, parking and use of common areas.  This Agreement specifically addresses pets and smoking.  See below under “Pets” and “Smoking”.

Pets:  No animals shall be brought on property without the prior consent of Owner. If consent is granted by Owner, User will be charged for each animal brought on the premise a fee of $40.00.  Pet deposits for long-term stays shall be negotiated and are non-refundable cleaning fees.  All pet rules (attached hereto and made apart hereof) shall be strictly adhered to by Users.

Smoking:  There is no smoking within 25 feet of any building, window, or door.  There is absolutely no smoking within 50 feet of any barn or storage facility.  Cigarette butts are to be extinguished with water and disposed of in an exterior trash can.

Cancellation Policy:  If agreement is cancelled a full 30 days prior to arrival date User shall be entitled to a full refund less all/any Paypal fees charged to Owner at the time of booking, or to return funds.  Reservations cancelled less than 30 days prior to arrival date will be charged a cancellation fee of one-half the total fees paid less all/any Paypal fees.  Any cancellations made less than 14 days prior to date of arrival will not be refunded.  Note: If owner is able to re-rent the premise for any days cancelled Owner will refund any portion of rental fees owner is able to recapture.

Assigning or Subletting.  Users will not assign this agreement or sublet any portion of the premises for any period of time without prior written consent of Owner.

Maintenance and Damage.  User acknowledges that, unless Owner is notified immediately upon occupancy, the premises, including the furniture, furnishings and appliances, are in good working order and repair.  User will keep the premises in a clean and sanitary condition, and will immediately notify Owner of any damage to the premises, its contents, or any inoperable equipment or appliances.  User will surrender the premises, at termination, in as good condition as received, normal wear and tear excepted.  User will be responsible for any damage caused by User or his or her family, invitees, and guests.  User will not commit any waste upon the premises, or any nuisance or act which may disturb the quiet enjoyment of any other occupant.  It is understood that Owner’s insurance does not cover Tenant’s personal possessions/property.

Entry and Inspection:  Owner will have the right to enter the premises; (a) for housekeeping services and utilize laundry facilities at any time during reasonable business hours including Saturday and Sunday; (b) in case of emergency; (c) to make necessary or agreed up repairs, decorations, alternations, improvements, to supply necessary or agreed services, to show the premises to prospective tenants, buyers, workers, lenders; (d) when tenant abandons or surrenders premise.  Except under (a) and (b) entry may be made only during normal business hours with at least 24 hours notice.  Users/Tenant agrees that 24 hour notice may be given to them via telephone or in writing.

Hold Harmless: Users agree to indemnify, defend and hold Owner harmless from and against any and all claims, actions, suits, judgments and demands arising from damage or injury caused by or to any person or any animal.  User agrees to disclose any and all hazardous or dangerous situations immediately to Owner.

All Users/Tenants, tenant’s invitees and guests all warrants that they can swim.  If they cannot swim they agree not to enter the swimming pool area.  Gates at swimming pool area are to remain closed at all times. User(s) acknowledge a wide variety of walking surfaces (even and uneven) at the swimming pool, in the courtyard and on the property.  User agrees to stay out of barns/behind all fencing and away from all livestock.  User/Tenant/occupants, user’s invitees and guests acknowledge that livestock, swimming pools, the courtyard and the interior./exterior  and the grounds of the residence in general could constitute a hazard.  User acknowledges they are aware that the above described style of life, activities and circumstance are potentially hazardous and they voluntarily participate and rent/lease the home with knowledge of the inherent danger involved in livestock, swimming, swimming pools, ranch land and generally leasing such a residence.  Users/Tenant/occupants, their invitees and guests further agree to assume any and all risks of direct or indirect bodily injury, death or property damage.

As consideration for having use of Owners property, User hereby agrees that all user/tenants/occupants, occupant’s invitees and guests, occupants assignees, heirs, distributes, guardians, next of kin, spouse, and legal representatives will not make a claim against, sue or attach the Owner’s property, her affiliates or associated legal organizations for injury or damage resulting from  negligence of any or other acts or occurrences, however caused, by any person, place or thing, as a result of occupying Owners property under this Agreement.  Further, user/tenant/occupants, tenant’s invitees and guest forever release Owner from any claim, from all actions, from any demand that User, occupants, invitees, guests, tenant’s assignees, heirs, distributes, guardians, next of kin, spouse, and legal representatives now have or may hereafter have for injury, and for damage resulting from User/Occupant/Tenant their invitees and guests using and occupying or visiting property.

 User/Tenant /occupants, tenant’s invitees and guests agree to minimize hazards and take all precaution and responsibilities.  Minor children under the age of 18 years of age are to be under direct supervision of a competent adult at all times while on the leased premise.   

Ordinances and Statutes:  User/Tenant will comply with all statutes, ordinances and requirements of all municipal, state and federal authorities now in force, or which may later be in force, regarding the use of the premises, including, but not limited to, the use or sale of illicit drugs, and the use and consumption of alcohol.

Notices:  Acceptable forms of communication are via telephone (415) 847-0014 during reasonable business hours defined as Monday-Saturday from 8am to 5pm.  User/Occupant/Tenant is also welcome to our on-site office during the hours of 9am-4pm Monday-Friday Only.    Email to lisamonticelli@yahoo.com  or utilizing our contact information through www.bonafidegroup.com are additional sources of communication.  Notices may be mailed to:  Box 494868, Redding, CA  96049.  

 Attorney’s Fees and Court Filings:  Any filing with any court regarding this agreement shall be filed in the County of Shasta.  Each party is responsible for their own attorneys’ fees regardless of outcome.  Mediation shall be the first remedy to all disagreements.  Arbitration shall be the second remedy to all disagreements.

House Rules

 Note:  The upstairs of Owner’s main home is for adult occupancy only.  The upstairs of that home is not child proof.  There are valuable breakables.  Users are responsible for full replacement value.

  •   Check-In is at 2pm.  Check out is at noon. 

Return home to the condition that it was found:

  1. Sweep floors;
  2. Clean up the outside grill and picnic table/tables;
  3. All soiled linens are to be placed in the laundry room.  Start your towels;
  4. Do dishes and put away or empty dishwasher;
  5. Wipe down stove;
  6. Empty all trash cans including bedrooms, bath and kitchen; and,
  7. Clean out everything in the refrigerator but usable condiments.
  1. If you choose not to clean the home up before your departure or do not have time, hiring our cleaning staff is an option.  Please plan in advance and pay for it now on line or directly through our office prior to departure. 

 

  •  Tie up trash and securing lids on trash cans at all times.  We are responsible for ordinary household trash only and nothing more. 
  • If you brought it, please take it with you!  If it is ours, leave it here!
  • Our towels and linens are not to be used at the beach, at the pool, or outside this premise.
  • If you borrowed it or break it, please put it back or replace it!
  • If you are doing personal laundry thank you for supplying your own laundry detergent and other daily use items that have been found in our cupboards.  If you have used the last of something, replace it!  If we need to purchase something, let us know.
  •  If you need anything special we probably can help you to find it in Redding. 
  • The limited number of guests you’ve  invited onto this  property must have the gate code in advance so they are not driving down our neighbors driveway!

 If our cleaning staff does not deliver this home to you in immaculate condition, always lets us know!

Pet Agreement

No Pets shall be brought on the premise for any reason without prior consent of Owner/Landlady.  All pet fees shall be paid in advance.  The purpose of this agreement is to obtain Occupant/Tenant guarantee to perform all contents of  this Pet Agreement faithfully.  Those terms, conditions, provisions are as follows:

 Dogs.  There is a maximum of one quiet, clean dog per residence.  Dog owner is responsible to leash the dog at all times while on the premise.  Dog will be walked away from the building and owner agrees that dogs will not urinate (mark) buildings or vehicles.  In the house; dog will be confined to a bedroom, on a dog bed situated on the floor that dog owner provides.  We prefer and highly recommend dog is crated in the house.  Dog’s in beds/linens or on furniture is absolutely prohibited.  Dog owner agrees to bring dog’s dishes and water bowls and agrees dishes in the cupboards are not for pet use.  We do not tolerate barking, whining or yipping.  Dog owner further agrees to relocate themselves if these simple requirements cannot be honored.  Additional pets on to the premise without advance permission are grounds for immediate termination of contract without refund.  Pet owner has checked PayPal pet option for a $40.00 per-pet fee.

Dogs are not allowed in courtyard at Churn Creek Estate.

Do not leave Dogs unattended in the house for any reason or length of time.

Cats.  There is a maximum of two quiet cats per residence.  Owner of pets agrees to fold and put away all Owner’s decorative bedding/decorative pillows during cats stay.  Owner agrees to scoop litter box not less than two times per day and dispose of waste in outside trash can each time.  Owner agrees to provide cat’s dishes and water bowls and understands dishes in the cupboards are not for pet use.  Any furnishings that are “clawed” will be replaced at the expense of cat owner at fair market value before they vacate the premise. Additional pets on to the premise are grounds for immediate termination of contract without refund.  Pet owner has checked PayPal pet option for $25.00 pet fee, or has put up additional security deposit.

Additional pet rules may be promulgated as Owner/Landlady deems necessary.
